From at least 05 November 2016 until liquidation on 30 September 2021 Alexandru Odainic (“Mr Odainic”) failed to ensure that Partition Solutions Limited (“Partition Solutions”) complied with its statutory obligations to submit accurate tax returns and make payments to HM Revenue & Customs (“HMRC”) as and when due, resulting in liabilities of at least £371,771 that remained unpaid at liquidation. Partition Solutions submitted inaccurate Value Added Tax (“VAT”) returns for the periods ended 30 September 2016 (submitted on 5 November 2016) and 31 December 2016 (submitted on 5 November 2016) HMRC raised assessments of VAT due from Partition Solutions, totalling £280,185, covering all the periods from quarter ended 30 September 2018 to quarter ended 31 March 2020 (inclusive) because the company had either submitted returns that incorrectly declared that no VAT was payable (periods to 31 March 2019), or had failed to submit returns at all (periods to 31 March 2020); Partition Solutions also failed to submit its Pay As You Earn tax/National Insurance Contributions (“PAYE/NIC”) and Construction Industry Scheme (“CIS”) tax returns and payments to HMRC as required from month ended 05 February 2019 onwards, causing HMRC to estimate the liabilities due; Partition Solutions’ last payments against its VAT and PAYE/NIC liabilities were made on 07 August 2018 and 28 November 2018 respectively. Partition Solutions’ outstanding liabilities to HMRC total £371,771, the company’s only other liabilities in liquidation being the sum of £10,000 owed to a trade creditor.
