From 28 February 2018, the date of the last year-end accounts, Amjad Ali (“Mr Ali”) failed to ensure that One Stop DIY LTD (“One Stop”) maintained and/or preserved adequate accounting records or, in the alternative, failed to deliver up such records to the liquidator. In the absence of any account accounting records delivered up to the Liquidator it has not been possible to: • Establish and verify the stock position of One Stop when it ceased trading or determine what happened to its stock and if sold or transferred to a connected company, whether adequate consideration was paid; • Establish and verify what happened to One Stop’s fixed assets with a net book value of £16,130 in the last year-end accounts and if sold or transferred to a connected company, whether adequate consideration was paid; • Verify the purpose and consideration for a receipt totalling £25,153 paid to One Stop on 13 January 2020 by a connected company, whether further sums were due from this company, whether the transaction was made in the ordinary course of business and had been declared to HMRC; • Verify the accuracy of the HMRC claim based on assessments totalling £31,804; • Establish and verify why One Stop Limited failed to pay the VAT liabilities due 17 August 2018 or to pay 4 County Court judgments incurred after 23 April 2019 and whether One Stop has entered into transactions which were detrimental to these creditors; • Verify the purpose and consideration for receipts totalling £39,656 received in 2019 from a connected company, Bridge Hardware Limited (In Liquidation), whether further sums were due from this company, whether the transactions were made in the ordinary course of business and had been declared to HMRC; • Verify if the £97,993 in purchases since 28 February 2018 from potential timber suppliers was for the benefit of One Stop or for a connected company; • Verify the purpose and consideration for receipts totalling £11,865 received in 2018 from a connected company, whether further sums were due from this company, whether the transactions were made in the ordinary course of business and had been declared to HMRC; • Determine and verify the extent of any continued trading after April 2019, when bank activity reduced, to 15 September 2021, the date of liquidation, and the extent that such trading did not pass through One Stop’s bank account.
