On 02 October 2020, Andrew Perkins (“Mr Perkins”) caused A & L General Building Ltd (“A&L”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating A&L’s turnover resulting in A&L receiving a larger loan, of £50,000, which it was not entitled to. In that: The BBL criteria allowed a business to borrow between £2,000 and up to 25% of the company turnover, with a maximum loan of £50,000 for the purpose of a business carried on or intended to be carried on by the applicant. The BBL scheme states the company’s turnover figure, even if self-certified by the applicant with no checks or evidence required, cannot be over-estimated by more than 25% in order to obtain a larger loan. The BBL application states that a company can apply for a loan which is up to 25% of the turnover in calendar year 2019 or if established after 01 January 2019, then an estimated annual turnover can be stated. A&L was incorporated on 22 January 2010 so actual turnover needed to be stated. On 02 October 2020, Mr Perkins applied for a BBL of £50,000 for A&L stating the turnover as £300,000 on the application form. Mr Perkins also confirmed on the application form that this was equal to or less than 25% of annual turnover for 2019. Accounts for the years ended 31 January 2019 and 31 January 2020 filed at Companies House did not show the company’s turnover. Receipts for the calendar year 2019 were circa £38,612 based on A&L’s bank statements. On 05 October 2020, BBL funds of £50,000 were paid into A&L’s bank account. At liquidation, A&L’s liabilities totalling £156,629 remained outstanding of which £50,429 was in respect of the BBL (and interest).
