Mr Adam Paul Lewis (“Mr Lewis”) failed to comply with his statutory duties to ensure that Atom Business Events Ltd (“Atom”) made timely returns and payments as and when due to HM Revenue &amp; Customs (“HMRC”) in relation to Value Added Tax (“VAT”) from quarter 02/16 to the cessation of trade (03/07/2018 Creditors Voluntary Liquidation “CVL”). As a result Mr Lewis caused Atom to trade to the detriment of HMRC from 07/04/2016 resulting in VAT liability of at least £128,232.87 and to his personal benefit, in that: VAT<br>HMRC records show that for quarters 02/16, 05/16 and 08/16 returns were submitted totalling £36,390.32 but that these returns remained unpaid.<br>HMRC records show that Atom failed to submit any further returns from quarter 11/16 to the cessation of trading.<br>Assessed liabilities due total £91,842.55, inclusive of surcharges totalling £10,553.55, for quarters 11/16 to 05/18<br>Atom fell into arrears with VAT during quarter 02/16 when payment for the tax return of £6,957.85 fell due and was not paid.<br>No payments were made to HMRC during Atom’s trading period<br>HMRC’s claim for VAT within the CVL is £132,694.87. However, an assessment raised on 20/08/18 in the amount of £4,462.00 is after the CVL date of 03/07/18. Accordingly, it is not included within this allegation giving rise to a revised claim of £128,232.87 including surcharges of £10,553.55. Comparative Treatment<br>Claims received in the Liquidation are HMRC in the amount of £133,094.87 and trade creditors in the amount of £19,609.80.<br>Analysis of the bank account shows that from 07/04/2016 (allegation start date) to 16/08/18 (account closure date) receipts total £1,236,739.79. Outgoing payments total £1,237,121.02. No payments to HMRC are recorded within this period.<br>The Liquidator has conducted a reconciliation of the bank account covering the full period of trade and has identified an estimated balance of £942,105.30 attributed to payments to which Mr Lewis has personally benefitted.
