Ajay Rajkumar Mirpuri (“Mr Mirpuri”) caused AJ Collections Ltd (“AJ Collections”) to fail to comply with the statutory obligations to submit all VAT returns on time and to make payments as and when due to HM Revenue and Customs (HMRC) from at least 07 September 2013, being the due date for the period ending July 2013, to circa April 2016. As a consequence, he caused AJ Collections to trade to the detriment of HMRC in respect of VAT from at least the period ending July 2013 and Corporation Tax (CT) from 01 March 2017. In that:<br>In June 2016 enquiries were initiated by HMRC due to AJ Collections not having submitted any VAT returns since the beginning of January 2010. As a result of their enquiries, HMRC determined that AJ Collections had failed to correctly calculate the input tax being reclaimed on all purchases and expenses regardless to taxable status.<br>Following revised figures provided by the company’s accountant HMRC raised VAT officer assessments totalling £141,100.00 against AJ Collections for the periods ending July 2013 to July 2014 and January 2015 to April 2016.<br>VAT returns listing accrued VAT liabilities of £120,831.52 were submitted for the VAT periods ending October 2014 and July 2016 to October 2017.<br>For the period ending July 2013 to October 2017 VAT of £277,319.95 (inclusive of Penalties and Surcharges) was due for payment against which payments of £51,069.72 were made during the period 03 February 2017 to 03 November 2017 leaving an outstanding liability of £226,250.23.<br>HMRC also re-assessed AJ Collections’ CT liability for the periods from 1st June 2015 to 31st July 2016 due to the additional profit with the result that £62,027.00 remained outstanding at the date of liquidation.<br>RTI PAYE Tax/NIC and interest totalling £8,720.74 for the 2016/17 tax year and the part 2017/18 tax year remained outstanding at the date of liquidation. Different Treatment<br>According to the accounts in the period from 1st June 2013 to 11th January 2018, the date of liquidation, sums paid to the connected company increased from £216,945 to £273,454.<br>According to the accounts for the period from 1st June 2015 to 31st July 2016 dividends totalling £206,000 were paid. he held 50% of the issued shares of AJ Collections.<br>Accounts show that for the accounting period ending 31 May 2012 HMRC liabilities stood at £228,236 whereas trade creditors were £21,119. As at liquidation HMRC liabilities were £469,779 and trade creditors £1,000.
