On 06 May 2020, Alan Baxter (“Mr Baxter”) caused Alan’s Leisure Limited (“AL”) to breach the terms of the Bounce Back Loan (“BBL”) Scheme, by applying for a BBL of £50,000, at least £48,843 of which was used for his personal benefit and not for the economic benefit of AL, in that: • On 06 May 2020, BBL funds of £50,000 were paid into AL’s bank account. • On 06 May 2020, £49,000 was transferred out of AL’s bank account to Mr Baxter’s personal bank account. • Prior to the receipt of the BBL funds, the balance on AL’s account was £157, meaning that at least £48,843 of the funds transferred to Mr Baxter’s personal bank account came from the BBL funds. • Mr Baxter has failed to provide evidence that the funds transferred to his personal bank account were used for the economic benefit of the company. On 15 December 2023, AL entered liquidation and the balance on the BBL outstanding at that time was £47,361.
