On 15 May 2020, Mr Martin Andrew Storey (“Martin Storey”) caused Storeys Removals Limited (“SR”) to make a second Bounce Back Loan (“BBL”) application of £50,000 when he knew or ought to have known that SR was not entitled to more than one BBL. Martin Storey made a wrongful declaration on the BBL application form confirming that the second BBL application was the only application for the business. As a result, SR received more BBL funds than it was entitled to and did not comply with the terms of the BBL scheme, in that: • The terms of the BBL Scheme stated that a business could apply for one loan of up to 25% of a Company’s turnover, from a minimum of £2,000, up to a maximum of £50,000. It was also a requirement of the scheme that the applicant confirm that no other BBL application had been made for the same business. • SR was incorporated on 14 March 2000 and commenced trading around that time. • On 06 May 2020, Martin Storey applied for a BBL of £50,000. On 11 May 2020, SR received a BBL of £50,000 from the first lender. • On 15 May 2020, Martin Storey applied for a second BBL of £50,000. Martin Storey declared on behalf of SR that this was the only application for a BBL. • On 21 May 2020, SR received a second BBL of £50,000 from the second lender. • Companies eligible under the BBL scheme were permitted to receive one loan, up to a maximum of £50,000. SR breached this requirement by obtaining two loans totalling £100,000. Total liabilities at Liquidation amount to £312,743 of which at least £36,464 and £38,699 relates to the amount owed in respect of the two BBL’s.
