Babar Saddiq failed to ensure that JB Foods Distribution Limited (JB Foods) complied with its statutory obligations to HM Revenue and Customs (“HMRC”) by failing to submit Value Added Tax (“VAT”) returns from commencement of trading in October 2014 until liquidation on 27 February 2017. As a result of his actions, the true level of J B Foods’ liability to HMRC was not known, in that: • HMRC received no VAT returns in respect of all periods from that ending 12/14 to 12/16 inclusive with the exception of one VAT return for the period ending 12/14 that was submitted to HMRC on 19 July 2016. Further information was requested by HMRC to support the 12/14 VAT return and this information was never provided. It was therefore not accepted. • As a result of the failure to submit returns, assessments were raised for the period 12/14 to the period 03/16 totalling £150,777. • An officer’s assessment in June 2016 assessed an additional amount of £411,723 due in respect of VAT for the periods 12/14 to 03/16. • A further assessment in respect of VAT due for the period ending 06/16 was raised in the sum of £96,281 and for the period from 1 July 2016 until liquidation an assessment was raised for £237,507. • During the period 1 September 2014 to liquidation, payments in respect of VAT were made totalling £102,835.10 against assessments raised totalling £896,288. • No payments have been made to HMRC in respect of VAT since 27 May 2016.
