1. On 08 May 2020 Mr Barnaby Procopiou (‘Mr Procopiou’) caused or allowed DBPP Ltd (‘DBPP’ and/or ‘the Company’) to apply for and obtain a Government-backed Bounce Back Loan (‘BBL’) of £50,000 by providing inaccurate information regarding its turnover in 2019, thereby obtaining at least £26,018 in BBL funding to which it was not entitled. In that: • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 (or estimated annual turnover from the date it commenced trading if it had been established after 01 January 2019), to a maximum of £50,000; • DBPP was incorporated in April 2017 and commenced trading at that time; • As DBPP was trading throughout 2019 it was not entitled to estimate its turnover on the application form; • DBPP’s accounts for the year to 30 April 2020 record turnover of £95,930, which would have entitled it to a BBL of no more than £23,982; • On 08 May 2020 Mr Procopiou’s co-director completed an application form for a BBL from DBPP’s bank, self-certifying that its turnover in 2019 was £200,000 and requesting a loan of £50,000. • The BBL was received on 11 May 2020; • By overstating its turnover on the BBL application form DBPP obtained £26,018 in BBL funding to which it was not entitled; • At the liquidation date £42,683 remained outstanding in respect of the BBL and the bank was the majority creditor. 2. Mr Procopiou failed to ensure that DBPP maintained and/or preserved adequate accounting records, or in the alternative, he failed to ensure that such records as were maintained and/or preserved, were delivered to the liquidator. As a result, it has not been possible to: • Explain the discrepancy between the banked income in the year to 30 April 2021, of £343,964, and the income shown in the accounts for the same period, of £26,240; • Account for the use of the Company’s bank account for receipts of £2,907,646 and payments of £1,742,106 in the period 04 May 2020 to 27 September 2022, which did not relate to its business; • Explain other income received in the period 04 May 2020 to 27 September 2022 of £627,839; • Verify that the Company has received all monies due to it, and/or whether there were any debtors outstanding at the liquidation date; • Ascertain the reason for payments made by the Company of £714,524, together with commission payments of £783,195, in the period 04 May 2020 to 27 September 2022, and verify that this was all legitimate company expenditure (or was accounted for in a director’s loan account); • Verify that the BBL was used in its entirety for the economic benefit of the Company’s business as required by the BBL scheme; • Ascertain whether any monies were due to or from HMRC in relation to any taxes; • Establish the full and true amounts due to or from the directors or any other connected parties in relation to loans and particularly director loan accounts; • Verify that all assets have been disclosed and delivered up, and/or that any disposals prior to the liquidation were for full and fair value and the Company received the benefit of these; • Verify that all creditors have been disclosed and that the amount declared as due to each of them is accurate; • Ascertain the reasons for the Company’s failure
