Between 7 February 2017 and 19 November 2019, Christian Roberts (“Mr Roberts”) caused Wisdom Exploits Limited (‘WEL’) to trade to the detriment of HM Revenue and Customs (“HMRC”) in respect of VAT and PAYE/NIC. As a result, WEL became unable to meet its financial commitments to HMRC as and when they became due:- VAT • Between 27 February 2017 and 16 August 2019, WEL made VAT returns for the periods 12/16 to 06/19 showing £75,598 of VAT due. During this time a payment was made to the total of £500, leaving a VAT balance of £79,625 remaining. • No further VAT returns were submitted and HMRC raised an assessment for the period 09/19 of £7,732. • HMRC are claiming £90,966 is the total amount owed for VAT. PAYE • Returns were submitted for the tax years 15/16 to 19/20 showing a total liability of £138,673. • Payments of £30,676 were received towards the liability and HMRC awarded credits totalling £14,000; leaving an outstanding balance of £93,997. • HMRC charged £191 interest for the tax year 15/16. • HMRC are claiming £94,656 for PAYE. Comparable Treatment • Professional accounts have been obtained up to the year ending 31st July 2018 and show that WEL was trading at a loss of £35,822. • Bank statements show that between 01 August 2018 and March 2020; when the account was closed; a total income of £329,925 was received and the total outgoings were £338,577. • From 1st August 2018, a total of £8,600 was paid to HMRC. • HMRC is the majority creditor owed £171,082.64, with the only other listed creditor being the Director, who is owed £2,500.
