On 04 and 05 August 2020 Mr Damion Lucas (‘Mr Lucas’) caused MJR Facilities Maintenance Ltd (‘MJR’) to make 2 payments to himself, each totalling £25,000. At the time of these payments MJR was insolvent in that it had unpaid invoices dating from September 2019 and owed at least £91,674 to trade creditors. These transactions constitute transactions to the detriment of creditors generally and to his own benefit. In that: On 03 August 2020 the credit balance on MJR’s bank account was £45,799; Claims received from creditors in the liquidation show that at least 2 creditors had invoices outstanding at that date, totalling £91,674; On 04 August 2020 £21,000 was paid into the account by a connected company and £25,347 was paid out, of which £25,000 was paid to Mr Lucas; On 05 August 2020 a further £25,018 was paid out, of which £25,000 was paid to Mr Lucas, leaving a balance on the account of £16,428; After this date a total of £60,924 was paid into the account and £77,250 was paid out, of which: £21,700 was paid to Mr Lucas; and £26,810 was paid to creditors who were included on the statement of affairs. Payments to Mr Lucas represent most of MJR’s income and 55% of its expenditure from 04 August 2020. The statement of affairs discloses trade and expense creditors of £110,889 and claims received by the liquidator show invoices dating from September 2019. No amount is shown as due to the connected company and Mr Lucas is included as a creditor for £500.
