On 16 June 2020 David Roy Howick (“Mr Howick”) on behalf of Denwells Limited (“Denwells”) applied for and obtained a Government backed Bounce Back Loan ("BBL") in the sum of £50,000 and caused the BBL funds to be used contrary to the purposes of the BBL criteria at a time when Denwells was insolvent. On 28 May 2020 Mr Howick signed an agreement selling the business and assets of Denwells to a third party, following which Denwells ceased to trade. No trading income was received by Denwells after the date of the sale. On 16 June 2020 Denwells received a BBL amounting to £50,000. On 17 June 2020 £35,000 of the BBL funds were paid to a connected company, and on 18 June 2020 £8,000 was paid to another connected company. These payments totalling £43,000 benefitted the connected companies and were of no economic benefit to Denwells, contrary to the BBL criteria. Denwells entered liquidation on 28 August 2020 owing £601,506 to creditors, of which £50,000 relates to the BBL.
