Clive Douglas Tidmarsh (“Mr Tidmarsh”) caused Designs Architecture Ltd (“Designs”) to trade to the detriment of HM Revenue and Customs (“HMRC”) by failing to make payments as and when they fell due in respect of VAT from at least 07 July 2015 to 25 September 2019, the date of Liquidation VAT - According to HMRC Ledgers, VAT returns submitted to HMRC for the quarters ended May 2015 to August 2018 detail an amount due to HMRC of £52,261. Four payments amounting to £20,490 were made against this debt on 12 May 2017, 29 June 2017, 21 December 2018 and 11 January 2019, leaving a net liability due of £31,771. - The Ledgers also detail assessments raised for the quarters ended 30 November 2018 to cessation, which amount to £23,518. No payments were made in respect of the assessments raised. - HMRC have made a claim in the Liquidation amounting to £68,100 . The claim is made up of the liabilities listed above in addition to the amount of £ 3,035 for a quarter prior to the allegation period and surcharges of £9,776. DIFFERENTIAL TREATMENT - Design’s last prepared accounts show that for the years ending 31st March 2017 and 2018, it had creditors (other than HMRC ) amounting to £19,510 and £17,642 respectively. According to HMRC VAT ledgers its indebtedness to HMRC for VAT stood at £18,832 and £23,801 for the same periods. At the time of its liquidation on 25 September 2019 Design’s other creditors had increased to £22,500 whilst its VAT liability to HMRC had increased to £68,100 (including surcharges)

An invoice dated 02 July 2012 for £250,000 plus VAT of £50,000 was not disclosed in the corresponding VAT return for the period to September 2012, which was submitted to HMRC on 07 November 2012. 3. An invoice dated 25 June 2013 for £250,000 plus VAT of £50,000 was not disclosed in the corresponding VAT return for the period to June 2013, which was submitted to HMRC on 07 August 2013. 4. The VAT under-declarations resulted in HMRC raising VAT assessments for the periods ending September 2011, September 2012 and June 2013 of £200,000, with additional penalties of £85,000 and interest of £8,745.51. At the date of administration, BHI had a liability to HMRC in regards to outstanding VAT of £211,765.46. 5. Since the first under-declaration of VAT, which took place on 02 November 2011 when the VAT return for the period ending September 2011 was submitted to HMRC, BHI has paid Mr Mallet £287,615 and other directors have been paid £234,167.28, whilst HMRC has only received £174,561.18.
