David MacDonald (“Mr MacDonald”) caused Horizon Industrial Services Ltd (“Company”) to apply for and obtain a Government backed Bounce Back Loan (“BBL”) in the sum of £50,000 which Mr MacDonald knew or ought to have known. The submitted BBL application contained false or inaccurate information, resulting in the Company obtaining more funds than it was entitled to. Thereafter in breach of the BBL scheme the BBL was not used in its entirely for the economic benefit of the business of the Company. In that: Eligibility In order to be eligible for a BBL, UK Government guidance states: - The applicant must be carrying on business on 1 March 2020 and be trading in the UK at the date of the application; - The applicant must have been adversely impacted by the coronavirus; - The applicant can borrow from £2,000 to £50,000 (up to a maximum of 25% of the company turnover); - The applicant must use the funds for the economic benefit of the company; and - The funds must not be used for personal benefit. Application - On 13 August 2020 Mr MacDonald, on behalf of the Company, applied for a Government backed BBL of £50,000; - The turnover of the Company was stated as £206,000 on the BBL application form; - The Unaudited Financial Statements for the Company to year end 31 October 2019 2020 states annual sales as £80,029; - Mr MacDonald overstated the turnover of the Company, obtaining an additional £29,992.75 in BBL funding to which the Company was not entitled to. Usage - On 17 August 2020 the sum of £50,000 was paid into the Company’s bank account. Prior to receipt of the BBL the balance of the Company bank account stood at £256.70 in credit; - In the period from 17 August 2020 to 15 November 2021, while the account received no other income, £42,635.14 was transferred to an account in the name of Mr MacDonald by means of fifteen transfers. - Mr MacDonald has not provided evidence that the funds transferred were used for the benefit of the Company. At liquidation £50,414.92 was outstanding in respect of the BBL. The lender bank is the sole creditor.
