On 04 September 2020, Dylan Addo (“Mr Addo”) caused D&A TM Ltd (“the Company”) to provide false or knowingly inaccurate information concerning the Company’s turnover in its application for a Government-backed Bounce Back Loan (“BBL”) of £20,000. In that: The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019, or the estimated turnover for the 12 months after the date it started its business if it had been established after 1 January 2019. The Company was incorporated on 21 May 2019 and commenced trading from that date. The Company drew down a £20,000 BBL on 23 September 2020, stating in the BBL application dated 04 September 2020 that the Company’s annual turnover was £80,000. However, accounts from 21 May 2019 to 31 May 2020 show the Company’s turnover was £29,055. These accounts were signed off by Mr Addo on 27 September 2020, just 4 days after the receipt of the BBL. The turnover reported in the accounts would have entitled the Company to a BBL of approximately £7,264. Whilst the BBL scheme allowed for estimated turnover to be used for the 12 months after the date it started its business, the Company had completed its first year of trading on 20 May 2020, over 3 months prior to making the application and had achieved an actual annual turnover and therefore Mr Addo would have known the estimated turnover stated in the BBL application was not correct. Mr Addo caused the Company to obtain an estimated £12,736 of BBL funding to which it was not entitled. The £20,000 BBL remained outstanding at the date of liquidation.
