Elizabeth Martins (“Ms Martins”) caused and/or allowed First Intl Healthcare Supplies Ltd (“Healthcare”) to make an application for a Bounce Back Loan (“BBL”) by providing false information relating to its turnover and trading activity to obtain a BBL totalling £49,500 when she knew or ought to have known that Healthcare was not eligible for the loan. The proceeds of the BBL have not been used for the benefit of Healthcare contrary to the terms of the BBL scheme. In that: • Under the BBL scheme, the applicant must be carrying on business on 01 March 2020 and the applicant also had to self-certify that they will use the loan to provide economic benefit to the business and not for personal use. • Dormant accounts as at 31 May 2019 were filed at Companies House for Healthcare. The accounts were approved on 21 January 2020 and signed by her. • Dormant accounts as at 31 May 2020 were filed at Companies House for Healthcare. The accounts were approved on 1 May 2021 and signed by her. • She has stated that the company had no turnover which is contrary to the terms of the BBL scheme. • In the BBL application form dated 16 May 2020, completed in her name, a declaration was made that Healthcare met the eligibility for the loan. The company turnover declared on the application form for 2019 was £198,000. • On 19 May 2020 the BBL of £49,500 was paid into Healthcare’s bank account. • On 19 May 2020 £49,000 was transferred to her personal bank account. • She has failed to provide evidence to show that the BBL funds were used for the economic benefit of the company. • On 13 September 2022, the financial institution which provided the BBL to Healthcare filed a winding-up petition against the company in respect of a liability of £50,502 in respect of the BBL. On 02 November 2022, a winding-up order was made against Healthcare. • At liquidation the only liability was that due to the BBL provider.
