On or after 10 July 2019, Faisal Ali (“Mr Ali”), acting as a director of Alex 7210 limited (“Alex”) whilst not formally appointed, caused Alex to dispose of goods subject to finance agreements to a connected party for no consideration, resulting in losses to the finance companies of £66,973 in that: • Documents were lodged with Companies House on 17 September 2019, stating that Mr Ali had resigned as a director on 04 June 2019. • On 10th and 11th July 2019 Mr Ali caused Alex to enter into two finance agreements, in relation to a shop fit out and provision of refrigeration equipment for premises leased in the name of Mr Ali. Under the terms of the finance agreements the goods remained the property of the finance companies. • No payments were made by Alex to the finance companies, and the finance companies sought to recover their property. • The finance companies were unable to recover their goods, as third parties connected to Mr Ali claimed to have purchased them from Alex and provided documentation to one of the finance companies to support their claim. The documentation included invoices for the sale of the goods, and a document purporting to be a bank statement showing payment to the bank account of Alex. • Bank statements for Alex show Alex did not receive these payments, contrary to the documentation provided to the finance company by the third party. • As a result of Alex failing to make any payment to the finance companies, and the finance companies having been unable to recover their property, the finance companies are owed £66,973 in the liquidation.
