1. Folasade Paseda caused Willing and Able Limited (hereinafter referred to as “W&A”) to obtain two Bounce Back Loans of £50,000 each, contrary to the terms of the Bounce Back Loan scheme in that: Applications for £50,000 Bounce Back Loans were submitted to a UK Bank on 05 May 2020 and to a second UK Bank on 05 May 2020 by Folasade Paseda. The terms of the Bounce Back Loan scheme as administered by the British Business Bank state that limited companies are only eligible to receive one Bounce Back Loan. W&A received £50,000 from a UK bank on 06 May 2020, and another £50,000 from the second UK bank on 07 May 2020 In the application for the second Bounce Back Loan, she signed a declaration that this was W&A’s only application for a Bounce Back Loan. Folasade Paseda knew or ought to have known that W&A was only eligible for one Bounce Back Loan. No repayment was made towards either Bounce Back Loan. W&A entered liquidation on 16 December 2020 with liabilities totalling £173,593. 2. Folasade Paseda caused W&A to enter into transactions to the detriment of its creditors, by causing/allowing payments totalling £36,000 to be made for the benefit of its directors at a time when the company was unable to pay its debts, in that: The directors of W&A approached Insolvency Practitioners on 04 September 2020 to seek advice on its financial position; The advice culminated in a board resolution on 3 November 2020 that the Company was unable to pay its debts. Folasade Paseda received payments totalling £26,000 (£10,000 on 12 November 2020, and £16,000 on 19 November 2020). A co-director received a single payment of £10,000 on 12 November 2020. W&A entered liquidation on 16 December 2020 with liabilities totalling £173,593.
