From 29 March 2019 at the latest to March 2021, when trading activity ceased, Mr Hill caused Revere to trade to the detriment of HM Revenue & Customs (“HMRC“) and the benefit of the directors resulting in £209,315 being owed in unpaid taxation. In that: Value Added Tax (‘VAT’) Revere’s VAT debt accrued from the quarter January 2017, when it did not file a return or make any payments; To 29 March 2019 Revere submitted VAT returns showing £111,969.72 due, with surcharges of £5,765.80 applied for late filings and payments, and payments made being £72,167.21; At 29 March 2019 Revere filed four VAT returns for the periods to April 2020 showing a further £63,379.10 due, thereafter no more returns were submitted and HMRC raised assessments totalling £82,385; Between 29 March 2019 and 23 October 2020 Revere made nine payments totalling £30,093.52 towards its accrued VAT debt. At liquidation HMRC ledgers show £167,750.98 is due in respect of VAT. Corporation Tax (“CT”) On 29 March 2019 Revere filed its outstanding CT returns for the period to 30 June 2018 showing £29,868.73 due; On 30 April 2020 Revere filed its CT return for the year to 30 June 2019 showing a further £40,361.45 due, resulting in £70,230.18 being owed; Between 01 November 2019 and 28 October 2020 Revere made payments totalling £28,666.02; At liquidation HMRC claimed £41,564 in relation to CT including interest and surcharges. Use of income and treatment of creditors From 29 March 2019 to cessation of trade Revere received £514,877.55 from trading income (not including a Bounce Back Loan (“BBL“) of £50,000) of which £58,659.54 was paid to HMRC and £362,942 transferred to the directors’ joint account; The amounts due to HMRC increased from £75,811.03 to at least £209,315.24; Apart from HMRC and the BBL, the only other creditor was a bank for an overdraft totalling £30,000.
