Between 1 August 2017 and the date of liquidation on 10 July 2019, Mr Gary Fieldman (“Mr Fieldman”) failed to ensure that First For Windows Limited (“FFW”) maintained and/or preserved adequate accounting records, or in the alternative failed to deliver up such records to the liquidator. The result of which is that it has not been possible to: • Verify whether expenditure from FFW’s bank account totalling £2,407,456 was to the company’s benefit, including payments totalling £169,680 paid to Mr Fieldman, and £46,021 to two additional connected parties. Of the £169,680, £100,398 has been explained as consultancy fees due to Mr Fieldman. • Confirm the purpose of unexplained payments from the company bank account totalling £404,668 • Verify whether the receipts into the company’s bank account totalling £2,406,948 are a true representation of all the company’s sales. • What happened to the Fixed assets totalling £15,000 and the stock valued at £32,500 at 31 July 2017. • Verify whether the debtors disclosed in the accounts to 31 July 2017 totalling £26,704 have been collected for the benefit of the company. • Determine the true trading relationship between FFW and the various trading entities used throughout the trading period from incorporation and in particular from 1 August 2017. • Establish whether payments to and from various connected and unconnected parties relate to loans, what the terms and conditions of these may be and what payments and repayments have been made. • Establish the financial position of the company between 1 August 2017 and liquidation or the cause of failure, which has been exacerbated by the failure to file accounts with Companies House to 31 July 2018.
