On 07 June 2016 Hedley David Moreton Midwinter (Mr Midwinter) caused a total of £1,160,633 to be transferred from Midwinter Transport Limited (MTL) bank account into his own bank account to the detriment of Midwinter’s creditors, and caused Midwinter to become insolvent as a result, in that: On 06 June 2016 MTL’s bank account received an insurance payment of £1,200,000 relating to a fire at the company trading premises. The following day, two transactions totalling £1,160,633 were paid to Mr Midwinter’s sole trader bank account. Mr Midwinter has not provided an explanation for the payments. The transactions meant that the company became insolvent as the company had already ceased trading and therefore would not be receiving any further income. As a result of these transactions, the funds from the insurance claim were unavailable to pay MTL’s creditors who remained unpaid at the date of Liquidation including the petitioning creditor.
