Between 22 June 2018 and 24 July 2018 Jack Christopher Day (“Mr Day”) caused the transfer of £17,775 from Xclusive Hospitality Limited for his personal benefit. The transfer of funds occurred after he had met with the Insolvency Practitioner on 21 June 2018, who would later become the Liquidator of the company. The transfer of funds was to the detriment of the company’s creditors and was made at a time when he was aware that the company was insolvent.<br>In an email dated 20 November 2019 the Liquidator confirmed to The Insolvency Service that at a meeting with him on 21 June 2018 the financial position of the company was discussed, and he had advised that he wanted to place Xclusive into liquidation. Xclusive was subsequently placed into liquidation on 07 August 2018.<br>Between 22 June 2018 and 24 July 2018, Xclusive received income of £20,599 which was credited to its bank account.<br>Between 22 June 2018 and 24 July 2018, 13 payments totalling £17,755 were made from Xclusive’s bank account to him and this included a single payment of £8,855 on 24 July 2018.<br>Analysis of Xclusive’s bank statements demonstrate that the payments to him during the period 22 June 2018 to 24 July 2018 totalling £17,755 compared to payments totalling £20,156 made in the period 15 August 2016 to 21 June 2018.<br>During the period 22 June 2018 to 24 July 2018 £8,195 was paid to creditors, of which £377 was paid to a creditor listed as such on the date of liquidation<br>On the liquidation of the company, creditors of Xclusive totalled £100,422.
