Jack Roberts (“Mr Roberts”) caused Outline Group Limited (“OGL”) to apply for and obtain a government backed Bounce Back Loan (“BBL”) when OGL was not eligible and failed to use the BBL for the economic benefit of the company in that: OGL was incorporated on 25 October 2018 and began to trade soon after. On 29 May 2020 Mr Roberts applied for a BBL of £45,000. The BBL application required Mr Roberts to confirm that the business was trading on 01 March 2020 and also on the date of the BBL application. Annual accounts for FYE 31/01/20 state the company ceased trading on 01 January 2020. Bank statements confirm that the final business income received into the company bank account was received on 10 January 2020. On O3 March 2020 an application to de-register the company for VAT was submitted to HMRC and signed by Mr Roberts confirming the business had ceased to trade on 31 January 2020. On 12 May 2020 an application to strike the company off was submitted to Companies House by the company accountant and signed by Mr Roberts. This was subsequently withdrawn by Mr Roberts On 11 June 2020 a BBL of £45,000 was received into the company bank account and on 13 June 2020, £44,800 was transferred from the company bank account to the personal bank account of Mr Roberts’ partner. Mr Roberts confirms that the BBL was used for his salary and personal expenses. Mr Roberts took a salary at a time when the company had ceased trading and he had been removed from the payroll of the company. This was not for the economic benefit of the company and contrary to the terms of use of the BBL. On 01 February 2022 OGL entered creditor’s voluntary liquidation with liabilities totalling £55,975, of which £41,745.31 was owed to the Bank in respect of the BBL.
