Mr Jakob Slack (“Mr Slack”) caused Regal Luxury Lodges Limited (“Regal”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by applying for a BBL of £50,000 on 11 May 2020 to which it was not entitled, withdrawing £50,000 for his own benefit and not for the economic benefit of Regal. In that: The BBL scheme was open to businesses engaged in trading or commercial activity in the UK at the date of the application and carrying on business on 1 March 2020 who were adversely affected by coronavirus. Under the BBL scheme businesses were also required to use the loan only to provide economic benefit to the company. Regal had ceased trading by early February 2020 following a break in and theft of tools and equipment in late January 2020. On 11 May 2020, Mr Slack made a BBL application in which he declared the turnover of Regal to be £450,000. Regal received a BBL of £50,000 on 12 May 2020. Regal’s bank statements show that on 12 May 2020, two payments of £25,000 each were made to Mr Slack. As at 22 January 2022, the date of liquidation, the BBL of £50,000 remains outstanding.
