Peter James Cook (“Mr Cook”) as the sole registered director of PJC London Limited (“PJCLL”) caused PJCLL to trade to the detriment of HM Revenue and Customs (“HMRC”) from 23 May 2017 when the Construction Industry Scheme (“CIS”) Tax liabilities for the tax month ended 05 May 2017 fell overdue for payment in full) and from 08 June 2017 (when the VAT liabilities for the VAT quarter ended 04/17 fell overdue for payment in full) until PJCLL was placed into liquidation on 13 August 2019. CIS tax 1) PJCLL submitted monthly CIS tax returns to HMRC for the tax years 2017/2018 (£34,269), 2018/2019 (£37,609) and from the tax months ended 05 May 2019 to 05 July 2019 (£7,141) disclosing CIS tax liabilities totalling £79,019 due to HMRC; 2) Between 09 June 2017 and 16 April 2018 PJCLL made payments totalling £5,965 to HMRC on account of its CIS tax liabilities. HMRC allocated £2,972 to the 2016/2017 tax year, £965 against the CIS tax liability of £2,807 for the tax month ended 05 May 2017 leaving a balance of £1,842 outstanding at liquidation. HMRC allocated £2,028 against the CIS tax liability for the tax month ended 05 February 2018. The oldest part liability was for the tax month ended 05 May 2017 of £1,842 which fell overdue for payment in full to HMRC on 23 May 2017; 3) At the date of liquidation CIS tax liabilities due to HMRC prior to the date of liquidation amounted to £80,230 (includes liabilities for 2016/2017 tax year) VAT 4) PJCLL submitted VAT returns to HMRC for nine consecutive VAT quarters ended: 04/17, 07/17,10/17, 01/18 (refund claim of £2,912),04/18, 07/18, 10/18, 01/19 and 04/19, disclosing VAT liabilities totalling £119,443. HMRC applied surcharges totalling £7,704; 5) PJCLL made two payments to HMRC on 15 June 2017 and 31 May 2018 totalling £1,180 on account of its VAT liabilities. HMRC applied these payments to VAT liabilities of £16,119 for the VAT quarter ended 04/17. HMRC also applied the VAT refund claim of £2,912 to this VAT quarter leaving a balance of £12,027 which fell overdue for payment in full to HMRC on 08 June 2017; 6) At the date of liquidation PJCLL’s VAT liabilities payable prior to the date of liquidation totalled £123,055. The oldest VAT liability was the part VAT liability for the VAT quarter ended 04/17 of £12,027 which fell overdue for payment in full to HMRC on 08 June 2017. Differential Treatment 7) At the date of liquidation, the total amount owed to creditors is £226,503 of which £223,617 (includes penalties and interest) is owed to HMRC in respect of CIS tax, VAT, PAYE/NIC and Corporation tax; 8) PJCLL’s accounts for the period ended 31 January 2018 show liabilities to trade creditors of £9,423 and liabilities to HMRC in respect of taxation and social security of £90,167. By the date of liquidation liabilities to trade creditors decreased by £6,537 from £9,423 to £2,886. Whilst over the same period liabilities to HMRC increased by £127,151 from £90,167 to £217,318 (includes penalties and interest of £1,617).
