James Robert Cross (“Mr Cross”) caused Psynapsis Ltd (“Psynapsis”) to trade to the detriment of HM Revenue & Customs (“HMRC”) in respect of PAYE/NIC & Student Loan deductions from 20 May 2014 to 01 December 2016 and for Value Added Tax (“VAT”) from 07 January 2015 to 01 December 2016 in that: PAYE/NIC & Student Loan deductions • For tax year 2014/2015, Psynapsis filed monthly RTI returns and had a PAYE/NIC liability totalling £14,184. The company made no payments resulting in an outstanding liability of £14,184. • For tax year 2015/2016, Psynapsis filed monthly RTI returns and had a PAYE/NIC and student loan deduction liability totalling £11,500. The company made no payments resulting in an outstanding liability of £11,500. • It is unknown whether the company filed PAYE/NIC returns and made payments for months April 2016 to 01 December 2016, when the company ceased trading. • At cessation of trade on 01 December 2016 the company had a PAYE/NIC & Student loan deduction liability of £25,684 plus penalties of £1,600. VAT • Psynapsis failed to file VAT returns for quarters ending 11/14 to 11/16 inclusive resulting in assessments totalling £31,262 plus surcharges of 4,689. Pysnapsis made no payments against this liability, resulting in an outstanding balance of £35,951. Comparable treatment • According to the available information, Pynapsis went into liquidation with liabilities of at least £89,149.14, of which at least £27,284 is in respect of PAYE/NIC & Student Loan Deductions and £36,481 is in respect of VAT. • From 04 September 2014 to 01 December 2016, receipts into Psynapsis’ bank account totalled £224,820 of which £25,938 were receipts from a connected company. During this period £5,532 was paid to HMRC, payments of £107,007 to trade & expense, £58,251 was paid to/the benefit of the director, £40,358 was paid to a connected company, £17,060 to unknown recipients, cash withdrawals of £5,433 and there were bank charges of £1,589.
