Jaspreet Randhawa (Ms Randhawa) caused Jay Soul Kitchen Limited (JSKL) to apply for a Bounce Back Loan (BBL) of £50,000 on 2 June 2020 when she knew, or ought to have known, that JKSL did not meet the criteria for that loan. • In order to be eligible for a BBL, a company had to be carrying on business as at 1 March 2020 and engaged in trading or commercial activity at the date on which the BBL application was made. JSKL was incorporated on 19 February 2020, but was not carrying on business on 1 March 2020. • On 2 June 2020 Ms Randhawa applied for a BBL on behalf of JKSL and made a declaration that the company was carrying on business on 1 March 2020. She stated on the application form that the annual turnover of the company was, or was estimated to be, £250,000. • On 4 June 2020, a BBL of £50,000 was paid into a bank account in the name of JSKL. • No draft accounts have been prepared for JSKL. • Bank statements show that the account was opened on 6 March 2020 with no transactions until the BBL was credited on 4 June 2020. • The director has confirmed that JKSL was not trading on 1 March 2020. The company was therefore not eligible to apply for the BBL. • No repayments were made to the BBL and at Liquidation, the only known creditor was the bank who provided the BBL.
