Jonathan Robert Hobbs, (“Mr Hobbs”), failed to ensure that J H Solutions (Grimsby) Ltd (“JHSGL”) maintained and/or preserved adequate accounting records, or in the alternative, following liquidation he failed to deliver up to the Liquidator such records as were maintained and/or preserved for the period from 31 March 2016 to 18 December 2019, the date of the Liquidation. 1) In that, for the period 31 March 2016, (the last prepared accounts recorded at Companies House), to closure of JHSGL’s rented office, at the latest on 11 July 2017, it has not been possible to determine: • The reasons for funds transferred out of JHSGL’s bank account totalling £35,817 between 16 January 2017 and 11 July 2017. • The reasons for funds transferred into JHSGL’s bank account totalling £15,100 between 10 March 2017 and 11 July 2017. • Whether expenditure on a credit card totalling £35,069 between 06 January 2017 and 11 July 2017 was for the sole benefit of JHSGL. • The reason for round payment amounts transferred out of JHSGL’s bank account totalling £18,300 between 06 January 2017 and 11 July 2017. • The reasons for cash withdrawals totalling £13,576 between 03 January 2017 and 11 July 2017. • The reasons for commercial credit card round figure payments totalling £9,400 made between 03 January 2017 and 11 July 2017. • What was paid to him during this period, and whether there was a director’s loan account. • How liabilities to HMRC of £112,184 for PAYE, £6,910 for VAT and £4,600 for Corporation Tax at liquidation were incurred in this period, what payments were made to HMRC and whether JHSGL was aware of the debt to HMRC. • Whether any amounts were outstanding to employees or JHSGL and whether PAYE/NIC in relation to employees was accounted for. 2) And for the period 12 July 2017, after the closure of JHSGL’s rented office, to the date of the Liquidation on 18 December 2019, it has not been possible to determine: • The reasons for funds transferred out of JHSGL’s bank account totalling £37,690 between 12 July and 18 December 2019. • The reasons for funds transferred into JHSGL’s bank account totalling £27,608 between 12 July 2017 and 18 December 2019. • Whether expenditure on a credit card totalling £25,707 between 12 July 2017 and 18 December 2019 was for the sole benefit of JHSGL. • The reason for round payment amounts transferred out of JHSGL’s bank account totalling £37,100 between 12 July 2017 and 18 December 2019. • The reasons for cash withdrawals totalling £18,402 between 12 July 2017 and 18 December 2019. • The reasons for commercial credit card round figure payments totalling £4,500 made between 12 July 2017 and 18 December 2019. • What was paid to him during this period, and whether there was a director’s loan account. • How liabilities to HMRC of £112,184 for PAYE, £6,910 for VAT and £4,600 for Corporation Tax at liquidation were incurred in this period, what payments were made to HMRC and whether JHSGL was aware of the debt to HMRC. • Whether any amounts were outstanding to employees or JHSGL and whether PAYE/NIC in relation to employees was accounted for. • The date when JHSGL ceased trading.
