On 10 February 2021, Julian Noel caused Thebestofeverything Ltd to breach the conditions of the Bounce Back Loan ("BBL") facility by applying for a BBL of £50,000 when he knew or ought to have known that Thebestofeverything Ltd was not entitled to the loan having started trading in January 2021 in that: ? Under the BBL scheme, businesses were able to apply for up to 25% of their turnover to a maximum of £50,000. In order to apply, borrowers were required to declare, amongst other things, that the business was engaged in trading or commercial activity in the UK at the date of the application and was carrying on business on 1 March 2020 and had been adversely affected by coronavirus (COVID-19). Julian Noel made an application for a BBL of £50,000 on behalf of Thebestofeverything Ltd on 10 February 2021 and signed the BBL agreement on 19 February 2021. The BBL funds were paid into Thebestofeverything Ltd’s bank account on 22 February 2021.??? Julian Noel submitted the BBL application form on 10 February 2021 and completed the BBL agreement on 19 February 2021 when he knew or ought to have known that Thebestofeverything Ltd was not eligible for the BBL scheme as it had been neither carrying on business on 01 March 2020 nor engaged in trading or commercial activity at the time of the application Analysis of bank statements provided by Metro bank, show that Thebestofeverything Ltd did not receive any trading income between 02 January 2018 and 10 February 2021. Accounts for a dormant company were filed at Companies House for the accounting years ending 28 February 2018, 28 February 2019 and 29 February 2020. Total liabilities at liquidation amount to £58,000 of which £50,000 relates to amounts owed in respect of the BBL.
