On 10 December 2020 Simon James Thomas (“Mr Thomas”) caused Evergene Limited (“Evergene”) to breach the terms and conditions of the Bounce Back Loan (“BBL”) scheme by overstating its turnover on a BBL application, when Mr Thomas knew or ought to have known that Evergene was not entitled to a BBL of £50,000, In that: • Under the BBL scheme businesses could apply for a loan of between £2,000 and £50,000 subject to a maximum of up to 25% of turnover. The turnover figure was self-certified by the applicant. The turnover figure required was that for the calendar year 2019 or where a business was established after 01 January 2019, the estimated annual turnover from the date that the business was started. • Evergene was incorporated on 05 April 2017 at which time the company commenced trading and as such was required to state its annual turnover for 2019 in the BBL application. • On 10 December 2020, Mr Thomas made a BBL application in the amount of £50,000 on behalf of Evergene declaring turnover of £205,000. On 14 December 2020 a BBL of £50,000, the maximum amount available under the BBL scheme, was paid into its bank account. • Evergene’s accounting information shows its turnover between 01 January 2019 and 31 December 2019 totalled £1,853 and therefore Evergene was not entitled to a BBL of any amount. • The overstatement of turnover meant that Evergreen received £50,000 more than it was entitled to from the BBL scheme. • Evergene entered Creditors Voluntary Liquidation on 10 December 2024 with total liabilities of £65,919, including the outstanding BBL of £44,919.
