On 12 May 2020 Jamie Rowatt (“Mr Rowatt”) applied for and obtained a Government-backed Bounce Back Loan (‘BBL’) of £50,000 from Lloyds Bank Plc for KR Clyde Valley Ltd (“KR Clyde”) to which it was not entitled, by providing false and/or inaccurate information regarding KR Clyde’s turnover. In that: Obtaining a BBL • A business was eligible for a BBL if it was engaged in trading or commercial activity in the UK at the date of the application, was carrying on business on 1 March 2020 and has been adversely affected by coronavirus (COVID-19). • The BBL scheme permitted a loan of up to 25% of a business’ turnover in the calendar year 2019 or estimated annual turnover if it had been established after 1 January 2019. • KR Clyde was incorporated on 15 April 2019. • Micro company accounts filed at Companies House on 6 June 2022 show the company was dormant in the year ending 30 April 2020 • The first transaction recorded in the KR Clyde’s bank account statements is the £50,000 BBL credit into the bank account on 13 May 2020 • The turnover in the bank account between 15 April 2019 and 12 May 2020 was £0 • On 12 May 2020 Mr Rowatt applied for a BBL of £50,000 stating that KR Clyde’s estimated annual turnover was £1,000,000 • Based on this KR Clyde was not eligible for a BBL Misuse of BBL: • As part of the Terms and Conditions, the borrower agreed they would use the BBL only to provide economic benefit to the business, and not for personal purposes. • On 13 May 2020 KR Clyde received £50,000 BBL credit into the business bank account • Between 13 May 2020 and 18 May 2020 KR Clyde paid £35,000 to a shareholder in the company. Mr Rowatt stated that the shareholder was an investor but did not provide any details of the investment and there is no record of payment being made into KR Clyde’s bank account. • Between 13 May 2020 and 18 May 2020 KR Clyde paid £4,000 to Mr Rowatt. Mr Rowatt stated that this was a management fee. • Between 19 June 2020 and 28 July 2020 KR Clyde paid £4,400 to a connected company. Mr Rowatt stated that was a loan repayment but failed to provide any details regarding the initial loan. This loan has not been recorded in the company accounts. • None of these transactions were shown to have been made for the economic benefit to KR Clyde
