Mr Keith Bennett (“Mr Bennett”) caused Anycolour Coatings Limited (“Anycolour Coatings”) to trade to the detriment of HM Revenue & Customs (“HMRC”) from 7 December 2020 in respect of VAT and from 22 November 2020 in respect of PAYE to liquidation on 26 October 2022, and from 1 November 2020 in respect of Corporation Tax (“CT”) of which from 18 January 2022 Mr Bennett knew or ought to have known the company was insolvent. In that: VAT: • Anycolour Coatings submitted VAT returns for the periods 10/20 to 10/21 • Anycolour fell into arrears on 7 December 2020 when payment for the period 10/20 fell due • Ledgers provided by HMRC show that on 17 January 2022 the outstanding balance owed to HMRC by Anycolour Coatings in respect to VAT, was at least £89,363 which included charges of £5,497. • On 17 January 2022 Mr Bennett sought advice from an Insolvency Practitioner and was advised that Anycolour Coatings was insolvent. • On 25 January 2022 Mr Bennett paid £3,000.00 to the Insolvency Practitioner from the bank account of Anycolour Coatings to place it into voluntary liquidation. • The information provided by Mr Bennett to the Insolvency Practitioner was not sufficient and as a result Anycolour Coatings was not put into voluntary liquidation and continued to trade. • Anycolour Coatings continued to submit VAT returns for the following 3 periods 01/22, 04/22 and 07/22 totalling £35,861.73. No payments were made by Anycolour Coatings towards this liability and charges totalling £5,379.25 were raised by HMRC giving a total liability for the three periods of £41,240.98. • Between 7 December 2020 and 26 October 2022 Anycolour Coatings made no payments to HMRC in respect to the outstanding liability. • As at the date of liquidation at least £130,604 was owed in respect of VAT including charges. PAYE • Anycolour Coatings submitted returns for PAYE/NIC from 5 November 2020 until 5 October 2022 • Anycolour fell into arrears on 22 November 2020 when payment for period 5 November 2020 fell due. • Ledgers provided by HMRC show that on 17 January 2022 the outstanding balance owed to HMRC by Anycolour Coatings in respect of PAYE/NIC was at least £30,365 including interest. No payments were made to HMRC towards this liability. • According to ledgers provided by HMRC between 18 January 2022 and 26 October 2022 an additional liability of £15,132 arose with respect to PAYE, NICs and interest. Anycolour Coatings did not make any payments towards this liability. • At the date of liquidation at least £45,708 was owed in respect of PAYE/NIC including charges. Corporation Tax (“CT”) • Anycolour Coatings CT liability for the period ending 31 January 2020 was £12,816 and due for payment by 1 November 2020. No payments were made by Anycolour Coatings towards this liability. • Anycolour Coatings CT liability for the period ending 31 January 2021 was £9,704 and due for payment by 1 November 2021. No payments were made by Anycolour Coatings towards this liability. • Anycolour Coatings CT liability for the period ending 31 January 2022 was £25,357 and due for payment by 1 November 2022. No payments were made by Anycolour Coatings towards this liability. • As at the date of liquidation £61,887 was owed in respect of CT Comparative treatment • A review of the bank statements of Anycolour Coatings between 22 November 2020 and 26 October 2022 shows that: Anycolour Coatings received income (less contras) of £920,985.14. Over the same period there were total debits from the account (less contras) of £917,218.69. Of which, debits for the direct or indirect benefit of Mr Bennett totalled £358,706.65 No payments were made to HMRC during this period. There were cash withdrawals totalling £25,782.97 Interest and charges totalled £9,693.39 Payments to all other creditors totalled £444,645.88 • At the date of liquidation, the outstanding liability owed to HMRC in respect to Corporation Tax; PAYE & NICs; VAT charges and interest was at least £238,200.29.
