Mr Kenneth Raymond Pratt (“Mr Pratt”) caused McKay & Innes Limited (McKay & Innes) to apply for a Bounce Back Loan (“BBL”) of £50,000 and did not use the loan monies for the economic benefit of the Company, contrary to the terms of the loan. In that: On 11 September 2020 Mr Pratt signed a bounce back loan agreement with the bank in which he declared: McKay & Innes required the bounce back loan of £50,000 because the business had been adversely affected by the Covid-19 pandemic, and McKay & Innes would use the loan for working capital and general business purposes solely for the economic benefit of the company. Despite the declaration on 27 October 2020 the £50,000 BBL was withdrawn from the bank account of McKay & Innes by cheque made payable to a connected company. Enquiries made of Mr Pratt revealed the full £50,000 BBL was used, by a further connected company, for the purchase of assets, which breached the terms of McKay& Innes’s lending agreement. On 15 March 2022 Mr Pratt placed McKay & Innes into Creditors Voluntary Liquidation with an estimated deficiency of £120,000 of which £50,000 is owed to the bank in respect of the bounce back loan.
