Between 19 April 2021 and 1 June 2021, Kevin Robert Robinson (‘Mr Robinson’) caused Home Fixed Limited (‘Home Fixed’) to transfer funds totalling at least £100,984 into a crypto currency exchange account. The transfers were made at a time when Mr Robinson knew or ought to have known that Home Fixed was insolvent. Mr Robinson knew or ought to have known that crypto currency was high risk, volatile and largely unregulated and that the transfers exposed Home Fixed to a high risk of loss to its creditors. The crypto currency ultimately failed resulting in a loss to Home Fixed of at least £97,326: Home Fixed was engaged in electrical installation, plumbing, heat and air conditioning installation and roofing activities. Abridged accounts for Home Fixed (signed on 25 March 2020) for the period from 26 June 2018 to 30 June 2019 showed a deficit of £16,745. Home Fixed was therefore balance sheet insolvent. Home Fixed accounting records showed a deficit on the Capital and Reserves account as at 30 March 2021 of £111,765 and record a trading loss for the year ended 30 June 2021 of £123,454 At 19 April 2021 Home Fixed owed HM Revenue & Customs the sum of £92,429 for Value Added Tax which had accrued since at least 08 August 2020. No payments have been made against the VAT liability since. In December 2020 Mr Robinson consulted a financial adviser in respect of the Company’s liquidity problems. Mr Robinson therefore knew or ought to have known that Home Fixed was insolvent. Between 19 April 2021 to 1 June 2021 sums totalling £100,984 were transferred from Home Fixed’s bank account to a crypto currency exchange account in Mr Robinson’s name. Crypto currency is considered to be high risk, volatile and largely unregulated; something that Mr Robinson knew or ought to have known. The transfers to the crypto exchange account therefore exposed Home Fixed to a high risk of loss. Between 24 May 2021 to 1 June 2021 £3,658 was credited to Home Fixed bank account from the crypto currency exchange account representing a loss of £97,326. Home Fixed’s outstanding liabilities in the liquidation total £315,781 consisting of £250,188 owed to HMRC, £48,626 to a bank and £16,967 to employees.
