Between 20 January 2016 and 12 September 2017 , Mr Lee James Burgon (“Mr Burgon”), failed to ensure that ASGB Holdings Limited (“ASGB”) maintained or preserved adequate accounting records or in the alternative, in the period on and after 12 September 2017 he failed to deliver up such records as were maintained or preserved. As a result of this it has not been possible to: a) Verify who had control of the affairs of ASGB throughout the period of Mr Burgon’s appointment; b) Establish the circumstances of how the Company went from a net positive position of £113,884 on 31 December 2016 to a negative position of £611,900 on 17 September 2017 namely; i. How the assets existing at 31 December 2016 were disposed of and if ASGB benefitted from the disposal of such assets; ii. If ASGB benefitted from book debts collected, and if not, whether recoveries can be made from the recipients of those funds; iii. Whether bad debts have been recovered and if not, can recoveries now be made; iv. Whether transfers to connected companies were transactions with a genuine trading purpose and if necessary, can be recovered. c) Determine if the Company submitted accurate VAT returns and if further repayment returns can be submitted for the benefit of creditors; d) Establish the veracity of loans and the repayment of those loans to individuals; e) Verify that deductions made from employee wages have been correctly accounted for to HMRC; f) Ensure that the trading activities of ASGB were compliant with Health and Safety legislation.
