Marina Farrow (“Mrs Farrow”) allowed East Yorkshire Machinery Limited (“EYML”) to continue to publish, cause to be published, devise or procure advertisements that were misleading, contrary to Regulation 3 of the Business Protection from Misleading Marketing Regulations 2008 (“BPRs”) and in contravention of undertakings pursuant to regulation 16 of the BPRs given by her co-director and an employee of EYML on 13 January 2016. • EYML traded in the buying and selling of second-hand tractors, agricultural machinery and plant equipment • As a result of complaints made to Trading Standards, on 13 January 2016, her co-director and an employee of EYML signed undertakings pursuant to regulation 16 of the BPRs. • The undertakings stated that her co-director and the employee would refrain from publishing or causing to publish advertisements that were misleading, particularly by false or misleading statements made verbally or otherwise in respect of the availability, nature, composition, date of manufacture, fitness for purpose or specification of tractors or other products offered for sale in the advertisement. • On 04 March 2016, Trading Standards sent a warning letter to her co-director stating that further complaints had been received that were an ongoing breach of Regulation 3 of the BPRs • Between 13 January 2016 and 06 October 2017, at least 11 customers purchased tractors and other goods advertised for sale from EYML with a value of at least £88,485. EYML failed to supply or deliver the goods to all 11 customers and failed to refund the sums paid to 10 of them. One customer only received a refund after obtaining a judgment in the county court against EYML. The remaining customers were owed at least £86,649 at liquidation. • Between 22 April 2016 and 20 May 2017, at least 7 customers purchased tractors and other goods advertised for sale from EYML with a value of at least £34,912. When delivered, the goods were either mis-described or not in the same condition as advertised. Three customers only received refunds after obtaining judgments in the county court against EYML. The remaining customers were owed at least £14,912 at liquidation. • In advertising and taking payments for tractors and other goods for sale that were either not available or were as described, her co-director and the employee contravened the undertakings given pursuant to regulation 16 of the BPRs on 13 January 2016. • On 17 November 2017, as a result of action taken by Trading Standards, her co-director and the employee signed further undertakings in the York County Court that they would not knowingly or recklessly publishing causing to be published, devising or procuring any advertisement which is misleading contrary to Regulation 3 of the BPR’s.
