Failed to take sufficient steps to protect the interests of the unsecured creditors generally between September 2017 and January 2018 (including HMRC) by failing to ensure that adequate steps were taken to determine what the Company could pay to HMRC to reduce the debt owed to it and made proposals to pay it. During the period September 2007 to the end of January 2018, the debt owing to HMRC increasing from approximately £28,500 on 9 August 2017 to over £82,000 for VAT and around £30,000 for PAYE/NIC at the end of January 2018). Should, consistent with the duties that he owed to the unsecured creditors of the Company as a whole, have caused the Company to cease to trade and be placed into CVL promptly after 5 April 2018. By causing the Company to continue to trade and not making any payment to HMRC, Mr. Banks caused the amount owed to HMRC to increase by around £121,000 between April and the end of November 2018, whilst still making payments to the Company's trade creditors and ensuring that its staff were paid. Failing to cause the Company to make any payment to HMRC from the 12th of April 2018 to the 29th of November 2018, whilst continuing to incur liabilities to it, because Mr. Banks had caused the Company to continue to trade, when he knew or ought to have known that there is no real prospect of HMRC being paid was a serious breach of duty by Mr. Banks over an extended period which resulted in substantial loss to HMRC. The PAYE/NIC liability increased from £38,273.30 for the tax year ending April 2018 to £69,896.42 as at November 2018. The VAT liability to HMRC increased from June 2017 from £21,847.83 to £171,324.55 in October 2018. HMRC was treated less favourably than other creditors, in that no payments were made to HMRC between June 2017 and 13 February 2018 and after 12 April 2018 (historic debt or future liabilities) but staff and other creditors did receive payment of future liabilities and payments against their legacy debts during these periods. After 13 February 2018 staff and trade creditors were paid and HMRC was not. That other creditors were preferred to HMRC is illustrated by the debt owed to HMRC increasing from £32,284 as at 30 June 2017 to £231,112 as at 27 November 2018 whereas liability to all other creditors increased over the same period from £117,061 to £144,311.
