Mr Mark Robert Davis (‘Mr Davis’) failed to ensure that 1K1 Ltd (‘1K1’) complied with its statutory obligations to file returns and to make payments when due to HM Revenue & Customs ('HMRC') for VAT and PAYE/NIC/CIS from his appointment as a director in April 2016. As a consequence he caused 1K1 to trade to the detriment of HMRC from at least January 2017 when VAT for the quarter to November 2016 fell due, to its liquidation in November 2019, resulting in at least £168,052 being due to HMRC for unpaid taxes. In that: • 1K1 was registered for VAT on 14 November 2014 and filed returns to the quarter ended August 2017; • Only one return was paid on time after Mr Davis’ appointment, that for August 2017, all other returns were either paid late or remained outstanding at the liquidation date; • No returns were filed after August 2017 and HMRC raised assessments to the liquidation date; o These assessments totalled £14,188 and are likely to understate the VAT due as VAT estimated from the bank receipts from November 2017 is £57,988; • At the liquidation date VAT of at least £42,651 remained unpaid, dating from the quarter to November 2016, which should have been settled by 07 January 2017; • PAYE/NIC/CIS of £114,431 was outstanding from the tax year 2016/17 onwards; • At the liquidation date trade and expense creditors were owed £22,363 and claims received date from April 2019; • Bank statements show payments of £1,039,913 from 13 November 2017, of which HMRC was paid £22,300 and Mr Davis received £54,652 (net); • The last payment was made to HMRC on 03 October 2018, although payments continued from the bank account until October 2019.
