Mr Martin Boulton (“Mr Boulton”) failed to ensure On Point Electrical Services Limited (“On Point”) complied with its statutory obligations to submit adequate payments to HM Revenue & Customs (“HMRC”) and caused On Point to trade to the detriment of HMRC in respect of PAYE, NIC and CIS from at least 22 April 2016 until 31 July 2019, the date of liquidation, as follows: • As at the period ending 05 April 2016, the amount outstanding to HMRC for PAYE, NIC and CIS was £10,209.63. • The company submitted monthly returns for the period 06/04/2016 to 05/04/2017 disclosing a liability in respect of PAYE/NIC of £24,761.32 against which credits for employer’s allowance totalling £3,000 were allocated and CIS totalling £37,740.01. Penalties of £2,560 and interest of £1,830.86 were incurred giving a total liability of £63,892.19 owed by the company for PAYE/NIC/CIS. • The company submitted monthly returns for the period 06/04/2017 to 05/04/2018 disclosing a liability in respect of PAYE/NIC of £17,315.73 against which credits for employer’s allowance totalling £3,000 were allocated and CIS totalling £28,012.55. Penalties of £5,533.45 were incurred giving a total liability of £47,861.73. • The company submitted monthly returns for the period 06/04/2018 to 05/04/2019 disclosing a liability in respect of PAYE/NIC of £17,320.29 against which credits for employer’s allowance totalling £3,000 were allocated and CIS totalling £54,823.48. Penalties of £1,350 were incurred giving a total liability of £70,493.77. • The company submitted PAYE and CIS returns for the period ending 05/05/19 and CIS return 05/06/19. No PAYE return was submitted for 05/06/19 which as a result was assessed by HMRC. The total liability in respect of PAYE/NIC and CIS was £5,267.01 which included a penalty of £100. • From quarter ending 02/17, VAT repayments totalling £65,339.08 were allocated against its outstanding PAYE/NIC/CIS liabilities. No other payments were made by the company. • At the date of liquidation, a total of £132,385.25 was outstanding in respect of PAYE, NIC and CIS for the period ending 05 April 2016 through to the period ending 05 June 2019 including interest and penalties. • At the date of liquidation, HMRC was the sole creditor of On Point with liabilities totalling £183,855. • An analysis of payments made from the company’s bank account from 22 May 2017 to 02 August 2019 shows that from total net expenditure of £1,721,202, trade and expense creditors received £753,266, Mr Boulton and associated parties received £418,282 and employees received £549,654. HMRC did not receive any payments from the company’s bank account in respect of PAYE/NIC/CIS.
