Between 01 March 2013 and 18 December 2017, Matthew Stephen Smith, (Mr Smith), failed to ensure that SQL Analytics Limited (SQL) met its financial commitments as regards to Value Added Tax (“VAT”), Corporation Tax (“CT”), Pay As You Earn/National Insurance Contribution (“PAYE/NIC”) and caused and allowed SQL to continue trading whilst withdrawing funds for the benefit of himself. As a result SQL became unable to meet its financial commitments to HM Revenue & Customs (“HMRC”) as and when they became due in that: • £75,349.23 is owed in respect of Corporation Tax for years ended 31 May 2012 to 31 May 2016 due for payment from 01 March 2013, and penalties of £3,044.32 for late filing of the company tax return for the year ended 31 March 2015. • £10,265.60 is owed in respect of RTI PAYE and NIC in respect of tax years 2012/13, and 2015/16 to 2017/2018 due for payment from 19 April 2013. A £500 end of year penalty is also outstanding for tax year 2012/13. • £29,707.33 is owed in respect of VAT and VAT assessments, and £2,275.05 in respect of VAT surcharges due for payment from 07 July 2015. • Year end accounts and corporation tax returns covering the period 01 March 2013 to mid December 2014 show that gross turnover was approximately £178,451.50 and net profit available for personal use totalled £98,056.93. Of this income HMRC received £750. • Bank statements covering the period 18 December 2014 to 18 December 2017 show that income received by SQL totalled £305,237.55. Of this sum £236,044.95 was paid for the benefit of Mr Smith and Mrs Smith, £39,429.80 was drawn as cash, and £27,362.80 was paid in respect of trade payments. Of this income HMRC received £2,400. • Over the period 01 March 2013 to 18 December 2017 the approximate income of SQL was £483,689.05. Of this income Mr and Mrs Smith received at least £334,101.88 whilst HMRC received £3,150. • The creditors of SQL total £132,826.89. HMRC has claimed a total of £131,990.69 in the liquidation.
