In the tax year 2016/2017, Mugurel Laurentiu Chiliment (“Mr Chiliment”) caused Chiliment Renders Ltd (“Renders”) to file three inaccurate VAT returns and inaccurate PAYE/NIC/CIS returns to HM Revenue & Customs (“HMRC”) resulting in an additional VAT liability of at least £110,772 (including interest of £2,726) and a PAYE/NIC/CIS liability of at least £111,230. • Renders filed three VAT returns for quarters ending 05/16 to 11/16 showing a VAT liability of £45,505. Renders made payments totalling £9,442 leaving an outstanding balance of £36,063. • On 16 August 2017 HMRC raised a Notice of VAT assessment totalling £169,766 plus interest of £2,726 for quarters ending 05/16 to 11/16 and for 05/17 as HMRC’s examination of payments received by Renders as a subcontractor showed that the amounts submitted in the VAT returns had been underdeclared. • The VAT due for the quarters ended 05/16 to 11/16 totalled £156,277. • HMRC’s winding-up petition and HMRC’s claim in the liquidation shows that for tax year 2016/2017 HMRC raised penalties of £73,851 in respect of PAYE/NIC for “inaccuracy(ies) in return(s) or other documents”. • HMRC’s claim in the liquidation shows that HMRC has claimed £37,379 in respect of Regulation 13 tax dated 05 April 2016.
