Mr Kaushik failed to ensure that MTH Leisure Limited (“MTH”) complied with its statutory obligations to make payments to HM Revenue & Customs (HMRC) in time and in full in respect of VAT and caused or allowed MTH to trade to the detriment of HMRC from 8 May 2017, resulting in a liability of at least £67,209.65, to HMRC at the date of liquidation, in that: • Under the Annual Accounting Scheme (AAS), VAT returns were submitted on 10 November 2014 and 22 November 2015 respectively. • Following MTH's removal from the AAS, it submitted five quarterly returns for the periods 12/15 to 12/16 inclusive. During this period, payment was made in full and, accordingly, the VAT account showed a zero balance at 8 February 2017. • MTH submitted a further five quarterly returns for the periods 03/17 to 03/18 inclusive in the total sum of £102,909.83. Payments totalling £35,700.18 were made by MTH in respect of these returns (with the last payment being made on 8 November 2017). By 7 May 2018, MTH owed HMRC £67,209.65 in relation to outstanding VAT (excluding surcharges of £6,921.51). • At Liquidation, HMRC was MTH’s majority creditor with liabilities of at least £67,209.65 (compared to other creditors who were owed £65,790.35) • Several creditors listed in the Statement of Affairs did not lodge claims in the liquidation and claims received in the liquidation totalled £7,959.10. • Analysis of MTH’s bank statements shows that between 8 May 2017 and Liquidation, £559,140 was withdrawn from the company account of which £341,932 was in respect of payments to suppliers, £147,452 was paid to a connected company in relation to staff wages, rent and other expenses and £28,985 on unknown payments. • In comparison, HMRC received payments of £35,700 in respect of VAT with no payments being made after 8 November 2017.
