Marc Harrison Black (“Mr Black”) caused Yorkshire Blow Dry Limited (‘YBD’) to breach the conditions of the Bounce Back Loan (“BBL”) scheme by applying for BBL of £50,000 on or around 17 June 2020 when he knew or ought to have known, that YBD did not meet the criteria for that loan. In that: • To be eligible for a BBL, a company had to be engaged in trading or commercial activity in the UK at the date of the application and had been adversely affected by Covid-19. The purpose of the loan was to provide economic benefit to the company and not for personal purposes. • Mr Black was appointed as director of YBD on Companies House on 01 June 2020. • There is no evidence that YBD was carrying on business at 01 March 2020, nor that it was engaged in trading or commercial activity at the date of the BBL application date on or around 17 June 2020, which is contrary to the terms of the BBL scheme. • In the BBL application form, completed by Mr Black, he stated that the Company was eligible for a BBL of £50,000, providing a stated turnover of £250,000 for calendar year 2019. • On 17 June 2020, Mr Black signed a BBL agreement and on 18 June 2020 a bounce back loan of £50,000 was paid into YBD’s bank account. • Mr Black transferred £44,950 of the BBL funds to Black Property Holdings Ltd and failed to provide evidence that the BBL funds were used for the economic benefit of the company. • No repayments were made to the BBL. Creditors at the date of liquidation total £68,080, comprising of the BBL liability totalling £50,963 and Trade and Expense creditors totalling £17,117.
