From 8 May 2018 to cessation of trade, Mark Derek Hornett (“Mr Hornett”) caused H3 Facilities Limited (“H3”) to fail to file statutory returns and to trade to the detriment of H M Revenue & Customs (“HMRC”) in respect of Value Added Tax (“VAT”) resulting in liabilities of at least £11,470 and from 23 November 2018 traded to the detriment of HMRC in respect of Construction Industry Scheme (“CIS”) payments resulting in CIS liabilities at liquidation totalling £96,406 (inclusive of charges and interest). VAT H3 registered for VAT on 20 November 2017. A nil VAT return was submitted to HMRC for the quarter ending December 2017. H3 failed to submit any VAT returns from quarter ending March 2018 to the quarter ending at least December 2019. In the absence of VAT returns HMRC raised assessments inclusive of surcharges totalling £12,670. Bank analysis shows that between January 2018 receipts into H3’s account totalled £650,813 net of receipts from connected companies. On 23 October 2018 a payment of £1,220 was made to HMRC referenced VAT CIS H3 registered for the CIS scheme on 24 April 2018. H3 submitted CIS returns between 5 November 2018 and 5 December 2019 detailing liabilities totalling £102,088 In the absence of CIS returns submitted between 5 January 2020 and 6 April 2020 (date of liquidation) HMRC raised CIS assessments totalling £596 On 11 December 2019 a payment of £10,951was made to HMRC. £96,406 in respect of CIS payments remains outstanding at liquidation. Comparative Treatment Bank statement analysis shows that from 8 May 2018 to date of liquidation receipts into the account total £723,851 from which payments totalling £386,368 were made to trading & expenses, £390,559 to sub-contractors, £51,783 to Mr Hornett and £97,789 to connected companies whilst payments to HMRC totalled £15,594.
