Mark Smith caused Lincolnshire Craft Beers Limited (“LCBL”) to trade to the detriment of HMRC from 22 July 2018 in respect of Pay As You Earn, National Insurance Contributions and Student Loan Deductions, from 07 July 2018 in respect of VAT and from 01 May 2019 in respect of Corporation Tax until liquidation on 03 July 2024. In that: Pay As You Earn, National Insurance Contributions and Student Loan Deductions • Mark Smith was appointed as director of LCBL on 23 June 2018. HMRC’s Winding Up petition shows the older unpaid tax liability dated back to the month ended 05 January 2018, which ought to have been paid in full by 22 January 2018. • As at 23 June 2018, LCBL had a total unpaid PAYE/NIC liability of £4,325.06. LCBL’s filed returns (including an assessment for Month 11) for Month 3 to Month 12 in the 2018/19 tax year show a total liability of £16,388.73. At liquidation, £14,573.24 remains outstanding. • LCBL’s filed returns for the 2019/20 tax year declared a total liability of £17,308.18. At liquidation, £14,308.18 remains outstanding. • LCBL’s filed returns for the 2020/21 tax year declared a total liability of £9,031.23. Value Added Tax • LCBL registered for VAT with effect from 01 June 2017. LCBL declared a VAT liability for the quarter ended 02/18 of £3,485.68, which became due and payable by 07 April 2018. HMRC records show that returns filed for the quarters ended 05/18 to 08/19, after the appointment of Mark Smith as director, declared a total liability of £55,166.67. • One payment of £2,189.57 was made in November 2018, which was allocated towards reducing the VAT liability for the quarter ended 08/18. Based on the VAT calculations provided to the Liquidator for the quarters ended 11/19 to 08/22, the surcharges for these 9 quarters would be recalculated at £10,537.17. Surcharges raised for the quarters ended 11/22 and 02/23 totalled £2,008.36. No payment was made, leaving the full sum outstanding at liquidation. • At liquidation, £193,280.19 is due in relation to VAT and surcharges for the relevant period. Corporation Tax • LCBL was incorporated on 16 May 2017. The first Corporation Tax return ought to have been filed by 31 May 2018. It failed to file Corporation Tax returns throughout trading. HMRC raised a CT determination of £3,800 and a penalty of £960 for the accounting period ended 31 May 2018. HMRC records show a payment of £200 was made in January 2020 and this was allocated towards payment of penalty. • In the absence of returns for the accounting periods ended 31 May 2019, 31 May 2020, 31 May 2021, 31 May 2022 and 31 May 2023, HMRC raised penalties totalling £3,700. The full amount remained outstanding at liquidation. • Interest totalling £866.53 was applied by HMRC. • At liquidation, HMRC claimed £9,126.53 including interest being due in relation to Corporation Tax. Comparative Treatment • LCBL’s records show that during the period of June 2018 to May 2024, it recorded a turnover totalling £669,931.53. During the same period, HMRC records show that a payment of £200 was paid towards the CT penalty, a payment of £2,189.57 was made in respect of VAT and payments totalling at least £5,479.80 were made in respect of PAYE/NIC. • At liquidation, HMRC is owed £257,379.87 in respect of the above tax liabilities. Claims received from other creditors totalled £38,190.26.
