Following his appointment as director on 1 January 2021 and Liquidation Mr Muhammad Asif (“Mr Asif”) failed to ensure that Flames Food Limited (“FFL”) maintained and/or preserved accounting records or in the alternative following the Liquidator’s appointment on 7 February 2022, failed to deliver up adequate records to explain the trading and financial position of FFL. As a consequence it has not been possible to account for the following: The position regarding the company’s income: • The company operated three bank accounts which reveal income from 1 January 2021 to 5 July 2021 totalling £98,157 including £20,670 paid by HM Revenue and Customs (“HMRC”) Job Retention Scheme (“JRS”). In the absence of adequate company accounting records it is not possible to determine if these amounts are a true reflection of the business income achieved during the period of trading. The position regarding the company’s expenditure: • The company operated three bank accounts which reveal expenditure from 1 January 2021 to 5 July 2021 totalling £98,752 of which £32,698 was paid to unknown or connected parties. In the absence of adequate company accounting records it is not possible to determine if these amounts were expended for the benefit of the company. The position with regard to the company assets: • The company failed to file accounts to 31 October 2020, due by 31 July 2021. In the absence of adequate company accounting records it is not possible to determine if the company assets were disposed of for the benefit of the company. The inability to verify/substantiate the level of remuneration paid to the director and the amounts owed to, or owed by, the director in respect of any director’s loan account.
