Muhammad Awais (“Mr Awais”) caused Premium Chauffeurs Limited (“PLC”) to breach the conditions of the Bounce Back Loan (“BBL”) Scheme by applying for a loan of £50,000 when the company was not eligible. In that: • Under the BBL scheme rules, a company that was carrying on business on 01 March 2020 was eligible for one BBL of 25% of its 2019 calendar year turnover, up to a maximum of £50,000. When making an application for a BBL, an applicant had to self-certify the company’s 2019 calendar year turnover. • PLC was incorporated on 22 May 2015. Mr Awais was appointed as a director on incorporation and remained as such until the PLC’s Liquidation on 17 March 2023. • On 20 May 2020 Mr Awais applied for a BBL of £50,000 from Bank A. On the application, he declared PLC’s turnover of 2019 to be £235,000. • PLC’s accounts filed at Companies House for the years ended 31 May 2016, 2017, 2018 and 2019 were dormant for those years. Analysis of PLC’s bank statements show that the first transactions in PLC’s account were on 04 May 2020. No evidence has been provided to show that that PLC was trading prior to these transactions. • It therefore appears that PLC was not carrying on business on 01 March 2020 and therefore it was not eligible for a BBL. • The £50,000 BBL entered PLC’s bank account on 21 May 2020. Prior to receipt of the BBL, the account balance was £1,260. • The BBL remains outstanding. Bank A is a creditor in the PLC’s liquidation and have entered a claim for £50,345.12.
