On 10 June 2020 Mohammed Ehsan Hussain (“Mr Hussain”) caused Fat Joe’s HW Ltd (“Joe’s”) to breach the conditions of the Bounce Back Loan (“BBL”) Scheme by applying for a BBL of £50,000, when he knew, or ought to have known, that based on the turnover in the accounts for the year 30 April 2020; Joe’s was only eligible to apply for a loan to a maximum of £10,472. Of the £50,000 Joe’s received, at least £23,080 was paid out for the personal benefit of Mr Hussain contrary to the conditions for the use of a BBL in that: • Joe’s commenced trading on 9 April 2019, first year’s trading accounts were for period ending 30 April 2020, turnover is recorded as £41,891. • Mr Hussain was the sole appointed director of Fat Joe’s HW Ltd throughout trading period • On 09 June 2020 Mr Hussain made an application to Metro bank for a Bounce Back Loan, stating the company turnover was £200,000. • On 10 June 2020 BBL funds of £50,000 were paid into the company bank account and the funds do not appear to have been used for the economic benefit of Joe’s • Between 12 June 2020 and 29 June 2020 £23,080 was withdrawn from the company account in cash, which includes a lump sum of £10,000 on 29 June 2020. The director offers no explanation for the use of this expenditure At Liquidation Joe’s owed £63,800 to its creditors, of which £50,000 was in respect of the BBL.
