Between 31 March 2019 (the date of the last filed year-end accounts) to the date of liquidation on 13 July 2021 (“the period”) Neil Roberts failed to ensure Total Comms UK Ltd (“Total Comms”) maintained and/or preserved adequate accounting records, or, in the alternative, following liquidation he failed to deliver up such records to the liquidators. As a result, it has not been possible to: • Determine, in the absence of sales records, whether £695,715 incoming into the company bank account was the total sales made by Total Comms during the period or if there were any book debts outstanding at liquidation. • Verify whether the payments out of the company bank account, totalling £708,025, were made for the benefit of Total Comms. • Verify the extent of any HMRC liabilities at liquidation. HMRC have issued a claim within the liquidation for £305,612. Of this amount, £250,291 in assessments and £13,613 of penalties was raised for the under-declaration of VAT for the 28 periods from 01 January 2017 to 31 December 2020. Total Comms paid HMRC £18,194 during the period. • Verify the company’s eligibility for the £50,000 Bounce Back Loan obtained on 18 May 2020. • Verify the final position of the Directors Loan Account. • Verify the date Total Comms ceased to trade. • Verify if Total Comms had any assets at liquidation. Total Comms’ last filed year-end accounts states the company had £25,057 of motor equipment, £12,063 of office equipment, and £18,810 of debtors.
