Nigel Robert Alexander Reynolds (“Mr Reynolds”) has failed to ensure that Hartwood Limited (“Hartwood”) maintained and/or preserved adequate accounting records from 11 February 2015 to Liquidation at 05 June 2019 or has failed to deliver up any such records to the Official Receiver. In the absence of adequate records it is not possible, in particular but not exclusively, to:- • Verify Mr Reynolds’ explanation that all Hartwood’s records were destroyed in a flood at his property in Spain. He is unable to provide a reference number for his insurance claim as he states he did not have insurance on the property. • Determine the reason for bank transfers totalling £284,345 to three account numbers of unknown beneficiary between 16 April 2015 and 04 October 2017 and determine whether these payments were in the best interests of Hartwood and its creditors. • Determine the reason for six payments in to Hartwood’s bank account from Her Majesty’s Revenue and Customs (“HMRC”) totalling £117,983 annotated “HMRC VAT Repay”. • Ascertain the accuracy of VAT assessments from 31 May 2015 onwards totalling £227,179 raised by HMRC in the absence of VAT returns. • Verify whether Hartwood have made deductions from sub-contractors pursuant to the HMRC Construction Industry Scheme (“CIS”) and verify the Regulation 13 Determination raised by HMRC in the total sum of £76,868 covering the period 5 April 2016 to 5 April 2017 in respect of CIS deductions that HMRC believe Hartwood ought to have made from sub-contractors but not paid to HMRC. • Mr Reynolds stated that he was the sole signatory on the bank account. Hartwood’s Bank have responded to The Insolvency Service stating that Nigel Reynolds and Nicholas Reynolds had signing rights. We do not know who Nicholas Reynolds is or his role in the Company. • Determine the purpose of two payments totalling £15,000 to N Reynolds on 07 May 2015 and whether these payments were in the best interests of Hartwood and its creditors. • Verify the cause of Hartwood’s failure and estimated deficiency of £316,087.
